Dr. Mark Nichols (who owns Houston Ear, Nose & Throat Clinic) wrote in my medical records that I “have a history of alcoholism.” I am not an alcoholic. (Try getting something like THAT in your medical records and see what kind of problems it can cause you!) 

After my wife wrote about the situation on her web site and complained to his licensing board, Dr. Nichols sued us for “libel, slander, and business disparagement.”  Dr. Nichols is suing us for $491,238.00

After Dr. Nichols sued us, he gave my medical record to his lawyer without my consent, which is against the law! The “Confidential Patient Health History” form that he gave to his lawyer had the word “alcoholism” circled on it. I am left handed. The “circling” doesn’t look remotely like the way I circle words. So far, Dr. Nichols and his lawyers have barred our Forensic Document Examiner from examining the original form. 

We don’t have the many thousands of dollars a lawyer would have cost (we estimate in excess of $75,000 by now), and we have been defending ourselves. This case has been going on for almost a year, and even defending ourselves, it has cost us approximately $15,000.

This case is set for trial the week of May 12th in the 133rd Judicial District, 301 Fannin (Old Civil Court Building), 5th Floor. Please come to trial and support us if you possibly can.
